01Agreement
Underway is operated by Wilder AI, a Colorado business (“Wilder AI”, “we”, “us”). These terms are an agreement between you and Wilder AI for your use of the Underway app, the Underway connector your AI assistant uses, and the underway.now website (together, “the service”).
By using the service you agree to these terms and acknowledge our privacy policy, which says what we collect and what we do with it. If you don’t agree, don’t use the service.
02A beta service
Underway is in beta. It is provided as it is, and it will change as we learn. In particular:
- Features may be changed or removed, sometimes without notice.
- There is no service level agreement. The service may be slow, unavailable or lose data, and we don’t promise any level of uptime.
- We may stop the beta, or the service, altogether. If we do, we will tell you ahead of time where we practically can, so you can ask for a copy of your data.
Keep your own copy of anything you can’t afford to lose.
03Eligibility
You must be at least 18 years old to use Underway. During the beta you need an invite to open an account, and each account is for one person. Don’t share your account, and don’t open more than one.
04Your account
Keep your sign-in secure. Your assistant signs in to Underway as you, so protect that sign-in as you would a password. You are responsible for what happens in your account. If you think someone else has used it, tell us at support@underway.now right away and we will help you lock it down.
05Your content
Everything you or your assistant put into Underway — tasks, notes, answers, your profile, projects and rules, and what your assistant records and reports back — is your content, and it stays yours.
You give Wilder AI a worldwide, non-exclusive, royalty-free license to host, store, copy, process and transmit your content, including to the providers named in our privacy policy, only as needed to run, secure and support the service for you. The license ends when your content is deleted, although deleted content can remain in our backup copies of the database for up to 30 days.
We don’t use your content to train AI models. You are responsible for having the right to put your content into the service, including anything in it about other people.
06Your assistant and your connectors
Underway does not act directly on your email, files, calendar or other accounts. Your own AI assistant does, on your instructions, using the connectors you set up with its provider and under your agreement with that provider. Underway gives it the task, the brief and the record of what has been done; what it then does in your accounts is up to you and your assistant.
You are responsible for what your assistant sends, changes or deletes on your behalf, and for setting your rules — the standing instructions that tell it what it may do without asking you. Underway starts you with rules that ask your assistant to prepare anything that would reach another person and leave the sending to you. You can change them, and if you do, the change is yours.
We are not responsible for your assistant’s provider, its connectors, or the services they connect to.
07AI output
Briefs, drafts, summaries and anything else produced by AI, whether by Underway or by your assistant, can be wrong, incomplete or out of date. Review it before you rely on it, act on it, or send it to anyone. It is not professional advice — legal, financial, medical or otherwise.
08Acceptable use
Don’t use the service to:
- break the law, or help anyone else break it;
- harass, deceive, defraud or otherwise harm other people, or send spam;
- try to break, probe, scan or overload the service, get around its limits or security, or reach anyone else’s data;
- copy, resell, sublicense or rent out the service, or give others access to your account;
- build a competing product by copying ours.
If you find a security problem, please tell us at support@underway.now rather than testing it further.
09Feedback
We welcome ideas and suggestions. If you send us feedback, we may use it freely, without owing you anything for it.
10Fees
Underway is free during the beta. If that changes, we will tell you before any charge applies, and you can leave rather than pay. Your AI assistant’s own subscription, if you have one, is between you and its provider.
11Termination
You can stop using Underway at any time, and ask us to delete your account and everything in it by emailing support@underway.now.
We may suspend or close your account if you breach these terms or if it is needed to protect the service or other people. We may also end the beta or the service, with notice where practical. The parts of these terms meant to outlast your account, including sections 7, 9 and 12 to 15, continue to apply after it ends.
12Disclaimers
The service is provided “as is” and “as available”. To the fullest extent the law allows, Wilder AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the service will be uninterrupted, secure, error-free, or that data will not be lost.
13Limitation of liability
To the fullest extent the law allows, Wilder AI is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the service or these terms, even if we were told they were possible.
Our total liability for all claims arising from or related to the service or these terms is limited to the greater of the fees you paid us for the service in the 12 months before the claim arose, or $50.
Some places don’t allow these limits, so some of them may not apply to you.
14Indemnity
If a third party brings a claim against Wilder AI because of your content or your misuse of the service, including what your assistant sends on your instructions in breach of these terms, you agree to cover the reasonable costs and losses that result.
15Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute will be heard in the state or federal courts located in Colorado, and you and Wilder AI both consent to their jurisdiction. This does not take away any protection the law of the place you live gives you and that cannot be waived.
16Changes to these terms
When we change these terms, we post the new version here and update the date at the top. If a change is material, we also email you before it takes effect, once we have your email address. If you keep using the service after a change takes effect, the new terms apply; if you don’t agree with them, stop using it and ask us to delete your data.
